FALSE NEWS REGARDING SUPREME COURT SETTING ASIDE CENTRAL & MAHARASHTRA GOVERNMENT’S ORDERS DATED 29.03.2020 & 31.03.2020 FOR PAYMENT OF FULL WAGES TO EMPLOYEES/WORKMEN DURING LOCK-DOWN
Kindly note that the aforesaid messages doing rounds on social media and whats app forward are FALSE, because the Writ Petition filed by Nagreeka Exports Ltd. is yet to be heard by the Supreme Court.
Though it is true that W.P.(C) No. 471/2020 has been filed by the Nagreeka Exports Ltd. on 18.04.2020 with Supreme Court alongwith an application pleading for urgent hearing. Intervention applications have been filed multiple parties as well. The writ petition challenges the constitutional validity of Government Order dated March 29, 2020 passed u/s 10(2)(I) of the Disaster Management Act, 2005 only to the limited extent where it is states “All the employers, be it in the industry or in the shops and commercial establishments, shall make payment of wages of their workers, at their work places, on the due date, without any deduction, for the period their establishments are under closure during lockdown period.” The Petition also challenges the subsequent Order dated March 31, 2020 issued by Government of Maharashtra, only to the limited extent of compelling private establishments, including the petitioner, to pay full salary to all its staff, workers, contract workers, casual workers during the period of lockdown due to COVID-19, when its factories are not operational.
